Experience and Practical Advice When You Face Foreclosure
At the Law Offices of Ardito & Ardito, LLP, our attorneys work closely with individuals and families who are facing foreclosure on their homes. Each of our partners has worked to protect the interests of homeowners throughout New York City and Long Island for more than 10 years.
In most instances, when we are assisting you with foreclosure issues, we are helping you identify ways to avoid foreclosure. Often, by aggressively defending a foreclosure proceeding, you can buy yourself the time you need to find an alternative to foreclosure.
We always look at the big picture, so that we can identify a solution that meets your needs. Contact us to set up a free initial consultation with a lawyer.
Our Foreclosure Defense Practice
In our experience, when homeowners assertively respond to a foreclosure lawsuit and mount a defense in court, the courts have been receptive and have customarily tried to help the homeowners. Unfortunately, because most people are unaware that they can oppose a foreclosure, mortgage lenders are virtually unopposed in foreclosure proceedings. Most lenders obtain a default judgment from the court because the homeowner fails to challenge the foreclosure.
At our law firm, we will aggressively defend your rights in a foreclosure proceeding. We recommend that you contact us as soon as you receive the foreclosure notice, but we can protect your rights at any stage of the process. However, if the deadline for responding to the lender's complaint has passed, you may not be able to make many legitimate arguments.
Defenses to a Foreclosure Action
In our years of practice, our attorneys have seen many effective defenses to foreclosure actions, including:
- Failure to record or defective recording of a mortgage or the assignment of a mortgage
- Accord and satisfaction--the homeowner actually made the payments, even though the bank claims otherwise
- Defects in the mortgage
- Defects in the notice of the foreclosure or in the documents filed seeking foreclosure
If there is a way that we can stop or postpone the foreclosure, we will make every effort to do so, providing you with time to find other alternatives.
